1. Agreement to These Terms
These Terms of Use govern your use of the empathiHR website and its content, forms, calculators, scheduling tools, and other website features.
The website is operated by empathiHR LLC ("empathiHR," "we," "us," or "our").
By accessing or using this website, you agree to these Terms. If you do not agree, please do not use the website.
If you use the website on behalf of a company or other organization, you represent that you are authorized to act on its behalf.
2. Website Information Is Not Legal Advice
The information on this website, including compliance summaries, statistics, calculators, guides, case studies, articles, and descriptions of employment laws, is provided for general informational purposes.
empathiHR provides HR consulting and compliance services. We are not a law firm, and website content is not legal advice. Nothing on this website creates an attorney-client relationship or substitutes for advice from qualified employment counsel concerning your specific circumstances.
Employment laws and agency guidance change. You should verify current requirements with the applicable government agency or legal counsel before relying on information from this website.
3. No Client Relationship Through Website Use
Using this website, submitting a contact form, scheduling an assessment, downloading information, or communicating with us does not create a consulting or client relationship.
Services provided to empathiHR clients are governed by a separate written engagement or services agreement. If these Terms conflict with a signed client agreement, the signed client agreement controls with respect to those services.
4. Compliance Assessments and Scheduling
A complimentary compliance assessment is an initial informational conversation. It is not a legal review, formal investigation, or guarantee that every potential compliance issue will be identified.
Information submitted through an assessment form or scheduling page is used to arrange and prepare for the requested conversation. Do not use an assessment or scheduling form to submit detailed workplace allegations, employee medical information, or confidential complaint evidence.
General assessment and scheduling forms are not designated misconduct-reporting channels.
5. Misconduct Reports and Hotline Use
If you are reporting workplace misconduct, harassment, discrimination, retaliation, or another workplace concern, use the reporting instructions provided by your employer or empathiHR's designated reporting page and hotline.
General contact forms, assessment forms, calculator forms, and scheduling forms should not be used to submit misconduct reports.
Hotline and investigation information is handled according to the applicable employer client's program, written procedures, contractual obligations, and applicable law. Confidentiality does not necessarily mean that information will remain known only to empathiHR. Information may need to be disclosed to authorized employer representatives, investigators, legal counsel, government agencies, courts, or other people involved in evaluating and responding to a report.
Anonymous reporting may be available under some client programs, but anonymity may limit the ability to investigate or respond.
The hotline is not an emergency service. If someone is in immediate danger or requires emergency assistance, call 911 or the appropriate local emergency authority.
6. Calculators and Interactive Tools
The Workplace Risk Cost Calculator and similar interactive tools provide directional planning estimates based on assumptions selected by the user.
Calculator results:
- Do not predict whether your organization will experience a claim, investigation, charge, or lawsuit.
- Are not legal, insurance, actuarial, accounting, or valuation advice.
- Are not estimates of the value of any actual or potential legal matter.
- Do not guarantee that any expenditure or compliance program will prevent a claim or produce a particular return.
Default assumptions are displayed on the calculator and may be changed by the user. Actual costs and outcomes depend on the facts and response to each matter.
If you request an emailed estimate, you authorize us to send the estimate to the address you provide and to respond concerning that request. Do not provide an email address that you do not own or have permission to use. Do not submit confidential complaint information through the calculator.
7. No Guaranteed Outcomes
Descriptions of empathiHR's services, methodology, experience, case studies, results, or potential risk reduction do not guarantee a particular legal, regulatory, financial, or workplace outcome.
Past results do not guarantee future results. Any legal defense, including the Faragher/Ellerth affirmative defense, depends on the facts, applicable law, the employer's actions, and consistent implementation of the relevant policies and procedures.
8. Intellectual Property
Unless otherwise stated, the website's text, graphics, branding, design, downloads, training descriptions, calculators, and other content belong to empathiHR or its licensors and are protected by applicable intellectual-property laws.
You may view, download, and print website materials for your personal or internal business use.
Without written permission, you may not:
- Republish, sell, license, or commercially distribute website content.
- Copy substantial portions of the website.
- Scrape, harvest, or systematically extract website content or data.
- Use website content to train, develop, or improve an artificial-intelligence model or commercial database.
- Remove copyright, trademark, or ownership notices.
- Misrepresent empathiHR content as your own.
9. Acceptable Use
You may not use this website to:
- Violate any applicable law.
- Transmit malicious code or harmful material.
- Attempt unauthorized access to the website, its servers, accounts, or connected systems.
- Interfere with the website's availability, security, or operation.
- Impersonate another person or misrepresent your identity or authority.
- Submit information you do not have the right to provide.
- Use automated systems to overload, monitor, or extract information from the website without permission.
- Submit knowingly false, fraudulent, or misleading information.
We may restrict or terminate access when we reasonably believe these Terms have been violated.
10. Third-Party Services and Links
This website may link to or use third-party services, including:
- Government statutes, agency guidance, and research sources.
- VideoPeel for video-based misconduct intake.
- Google Workspace, Google Calendar, and Google Meet for business communications and scheduling.
- Vercel for website hosting and analytics.
- Resend for email delivery.
Third-party services are governed by their own terms and privacy practices. We do not control and are not responsible for the availability, security, content, or practices of third-party websites or services.
A link to a third-party resource does not necessarily constitute an endorsement.

Our collection and use of personal information is described in the empathiHR Privacy Policy.
When submitting a website form, you acknowledge that your information will be handled as described in that policy.
12. Website Availability and Disclaimer of Warranties
The website is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, empathiHR disclaims all express and implied warranties relating to the website, including warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:

To the maximum extent permitted by law, empathiHR and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or connected with use of the website.
To the maximum extent permitted by law, empathiHR's total liability arising from or connected with use of the website will not exceed one hundred dollars ($100).
These limitations do not exclude liability that cannot legally be excluded or limited.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute arising from or relating to use of this website must be brought in a state or federal court serving Collin County, Texas. You consent to the personal jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms periodically. The "Last updated" date identifies the current version.
Material changes will be communicated when required by law. Continued use of the website after an updated version becomes effective constitutes acceptance of the revised Terms.
16. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
A failure to enforce a provision is not a waiver of the right to enforce it later.
